Cutting Consent Agreement Sought

TREMONT — Town manager Millard Billings is recommending selectmen attempt to enter into a consent agreement with the property owner who allegedly violated the town’s zoning ordinance by improperly removing vegetation from a resource protection zone near Mitchell Marsh.

Mr. Billings, who is also the town’s code enforcement officer, issued a notice of violation to James Metzger of Darien, Conn. on Dec. 4. The notice states that 20,250 square feet of forest canopy was removed. The ordinance allows only 250 square feet of canopy within the zone to be removed.

Mr. Billings submitted a draft of the consent agreement to selectmen on Monday.

The proposed consent agreement requires Mr. Metzger to replant trees in the area of the violation following a plan developed for the site by state district forester James Ecker.
