Former gubernatorial candidate Eliot Cutler arrested on child porn charges



ELLSWORTH — Unsuccessful two-time independent gubernatorial candidate Eliot Cutler has been charged with four counts of possession of sexually explicit material of a minor under 12 years of age, District Attorney Matt Foster said.

Sexually explicit materials are defined by Maine law as “material that depicts a person who has not attained 16 years of age engaging in sexually explicit conduct,” Foster said.

The Maine State Police Computer Crimes Unit arrested Cutler, 75, at his Naskeag Point Road residence in Brooklin at 4 p.m. on Friday, according to Maine State Police spokeswoman Shannon Moss.

Cutler was taken to the Hancock County Jail, where he was freed Saturday on $50,000 cash bail, according to corrections officials.

The Maine State Police last Wednesday executed search warrants of Cutler’s residences in Brooklin and Portland.
Those search warrant affidavits have been sealed, according to court officials.

Augusta attorney Walter McKee represents Cutler and successfully filed a motion last weekend to have the arrest warrant affidavit sealed — with an eye toward jury selection.

“Dissemination of the information would result in the public dissemination of prejudicial information that could interfere with the ability of a court to impanel an impartial jury,” McKee said Tuesday.

Although the Maine Attorney General’s Office has assisted in the case, Foster is prosecuting the case against the former gubernatorial candidate.

“The AG’s Office was involved in the early stages to assist the MSP [Maine State Police] with review of their search warrants,” Foster said.

Cutler is a Bangor native and an attorney who worked under the Carter administration in the U.S. Office of Management and Budget.
